2.1. By clicking "Register," "Buy," or accessing any part of the Platform, the Student agrees to be legally bound by these Terms.
2.2. The Student warrants that they are at least 18 years of age or possess written legal consent from a guardian to enter into this agreement.
2.3. These Terms constitute the entire agreement between the parties, superseding all prior agreements or representations.
3.1. Non-Accredited Status: The Student explicitly acknowledges and accepts that MESHED Learning is a private competency provider. The Company is NOT currently accredited by the Quality Council for Trades and Occupations (QCTO), the South African Qualifications Authority (SAQA), or any Sector Education and Training Authority (SETA).
3.2. Nature of Certification: Certificates issued by MESHED Learning certify competency and skills acquisition based on international standards and proprietary industry frameworks. They do not constitute a "National Certificate" or "Diploma" as defined by the NQF Act.
3.3. Waiver of Claims: The Student hereby waives any claim against the Company regarding the recognition of these qualifications by third-party institutions or employers. The Student enrolls with full knowledge of this status.
4.1. Instructorless Format: The Student acknowledges that course lectures are asynchronous and automated. There is no live, real-time human lecturer delivering the video content.
4.2. Use of Synthetic Media (AI): The Company utilizes advanced proprietary methodologies, including Artificial Intelligence and Synthetic Media, to generate, structure, and vocalize learning materials. By using the Platform, the Student consents to learning from material that may be synthetically generated but is verified for accuracy by human subject matter experts.
4.3. Third-Party Tools: Courses may require the installation of third-party software (e.g., XAMPP, VS Code). The Company provides guides for these tools but accepts no liability for:
5.1. Mobile Device Exclusion: The Platform is engineered for wide-screen formats. Accessing lessons via a mobile phone or tablet is strictly prohibited for educational consumption.
5.2. Liability Waiver: The Company warrants the functionality of the Platform only on Laptop and Desktop computers running modern web browsers. The Company shall not be liable for display errors, missing interface elements, or submission failures if the Student attempts to use a mobile device.
5.3. Connectivity: The Student is solely responsible for obtaining and maintaining their own internet connection and data.
6.1. Assessment Protocol: Students must complete Module Assessments consisting of Multiple Choice, True/False, and Open Text questions.
6.2. Hybrid Marking Mechanism:
6.3. Assignments: Proof of work must be submitted via upload or functional URL. If a submitted link is inaccessible (e.g., "404 Error" or private permission settings), the assignment will be marked as zero (0).
6.4. Dispute Resolution Procedure:
7.1. The Company provides education, not recruitment services.
7.2. The Company does not guarantee employment, interviews, or salary adjustments upon completion of the course. The Company is not liable for the hiring criteria of any third-party employer.
8.1. Payment Clearance: Enrollment is strictly conditional upon the visible clearance of funds in the Company’s bank account. "Proof of Payment" documents are for reference only and do not guarantee access until funds reflect.
8.2. The "Module 3" Refund Policy:
9.1. Conditions for Issue: Certificates are only issued upon passing all required modules.
9.2. Data Accuracy: The Student is solely responsible for the accuracy of their full name and physical delivery address.
9.3. Courier Liability:
10.1. Company IP: All course content, videos, text, code snippets, and methodologies on the Platform are the exclusive property of Mahanaim Empire (Pty) Ltd. Unauthorized copying, screen recording, or distribution is a criminal offense.
10.2. Student IP: The Student retains copyright of their "Reflections" and "Assignments." However, the Student grants the Company a perpetual, non-exclusive, royalty-free license to use, store, and display this content for the purposes of grading, moderation, and internal quality assurance.
11.1. General Limitation: To the maximum extent permitted by the Consumer Protection Act 68 of 2008, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:
11.2. Indemnity: The Student agrees to indemnify and hold harmless Mahanaim Empire (Pty) Ltd, its directors, employees, and agents from any claims arising out of the Student’s violation of these Terms or violation of any rights of another.
12.1. The Company reserves the right to suspend or terminate a Student’s account immediately and without notice if:
13.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
13.2. The parties consent to the jurisdiction of the Magistrate’s Court for any litigation arising from these Terms, notwithstanding that the amount in dispute may exceed the jurisdiction of such court.
